Comments change fast, so evidence comes first

Comments are edited, deleted and buried in long discussions within hours. Before anything is reported, the comment, its parent, its permalink, the username and the timestamp should be captured. The permalink to the specific comment, not just the post link, is what a reviewer needs.

Why a comment is hard to remove

A comment is one person's statement inside a larger conversation, and reviewers read it in context. Sarcasm, exaggeration and opinion are treated differently from statements of fact. U.S. law draws a similar line: in Milkovich v. Lorain Journal, the Supreme Court held that statements which cannot reasonably be read as stating actual facts, or cannot be proven false, are protected.

So "this company is terrible" is opinion. "This company kept my deposit" is a factual claim that can be true or false. The second is something a report, or a lawyer, can address.

Anonymous authors

If a comment is defamatory, the author is the legally responsible party, not Reddit (Section 230). Courts in Dendrite and Cahill require a substantial showing, with real evidence, before they will order an anonymous speaker identified. We do not try to identify anonymous users. If you are considering legal action against an author, that is a decision for a lawyer.

Reddit rules that apply.

A comment is judged on its own words. These are the rules we use to decide whether a reply can be reported.

  • Rule 1

    Remember the human

    Abusive replies are the classic case: insults aimed at a person, threats, or encouraging others to attack them. The test is the conduct toward a person, not how harsh the opinion is.

  • Rule 3

    Respect the privacy of others

    Replies that say where someone lives or works, or post their private messages, break this rule even when the post above them is harmless. Each such comment needs its own link.

  • Rule 5

    Be authentic

    Comments from accounts posing as customers, staff or officials can break this rule. Evidence that the account is deceptive is what a reviewer needs to see.

Legal background

The law behind it.

Courts separate statements of fact from opinion. That distinction decides which comments have a legal angle and which can only be handled under the rules.

Milkovich v. Lorain Journal Co.

497 U.S. 1 (1990)

The Court declined to create a blanket constitutional privilege for "opinion", but confirmed that statements which cannot reasonably be interpreted as stating actual facts, or which cannot be proven false, are protected.

Why it matters here: "This company is terrible" is opinion. "This company stole my deposit" is a factual claim that can be true or false. The second can be challenged; the first generally cannot.

Krinsky v. Doe 6

159 Cal.App.4th 1154 (Cal. Ct. App. 2008)

A company executive tried to unmask an anonymous poster who had insulted her on a Yahoo! message board. The court held that a plaintiff must make a prima facie showing of a valid claim before an identity is disclosed, and found that the crude statements were non-actionable opinion and rhetorical hyperbole. The subpoena was quashed.

Why it matters here: Insults and exaggeration on a forum rarely meet the bar for unmasking. Comments of this kind are usually dealt with through the platform's rules, not a lawsuit.

What was done
He filed suit in January 2018. The news report describing the filing does not say how the case ended, and we have not verified an outcome.
Outcome
Filed. The reported source gives no outcome.
What it teaches
Suing a platform over what users wrote runs into Section 230, and unmasking commenters requires a substantial legal showing. A suit also draws more attention to the discussion.

What it teaches
Even when the request comes from law enforcement, good-faith criticism is protected on Reddit. The realistic targets are content that breaks the Rules, not content that merely criticises.
