The first day

When a post breaks out, three things matter at once. Report anything that breaks the Reddit Rules immediately (personal information, harassment, impersonation, false claims about named people). Preserve evidence, because posts get edited and deleted. And decide who will speak for you, if anyone, and from which account.

What not to do

Do not argue in the comments, and do not use alternate accounts to defend yourself. Replying can push the post up and hands people more to quote, and undisclosed accounts are a serious risk if discovered. A single factual reply from an identified account, written calmly, often does more than a flood of reports.

Why speed and accuracy both matter

The 2013 Boston Marathon misidentification is the clearest example of how fast a false claim about a private person can spread on Reddit, and of the harm it does. Reddit's general manager apologised publicly for the "witch hunts". Reports that are specific, evidenced and filed early are the ones reviewers can act on.

When a story is spreading, speed matters, but only the posts that break a rule can be removed. These are the rules we check first.

  • Rule 1

    Remember the human

    When a post is spreading because of harassment or pile-ons, this rule can justify a fast report on the specific posts driving it. Reports about comments that are merely negative will not move.

  • Rule 3

    Respect the privacy of others

    A post that exposes private details spreads quickly and does real harm, so this rule is the basis for asking for urgent action on it.

  • Rule 5

    Be authentic

    A coordinated or fake-account campaign is a matter for this rule. We document the accounts and their patterns, and keep that separate from real people who are simply angry.

Gertz v. Robert Welch, Inc.

418 U.S. 323 (1974)

The Court held that states may let private individuals recover for defamation on a showing of fault, while limiting presumed and punitive damages unless actual malice is shown. It draws the line between public figures and private people.

Why it matters here: Whether you are a public figure changes how hard a defamation claim is. Founders and executives of well-known companies are often treated as public figures for related statements.

Obsidian Finance Group, LLC v. Cox

740 F.3d 1284 (9th Cir. 2014)

A blogger accused a financial firm and its principal of fraud in online posts and a jury awarded $2.5 million. The Ninth Circuit held that a blogger writing about a matter of public concern has the same First Amendment protection as traditional media, that a private-figure plaintiff must prove at least negligence, and that the jury had been instructed wrongly. The verdict was partly reversed.

Why it matters here: Anyone who posts online, not only journalists, gets the benefit of the fault and falsity requirements. A negative post is not defamatory merely because it is harsh or unwelcome.

Defamation Act 2013 (UK) and Lachaux v Independent Print Ltd

[2019] UKSC 27

Section 1 provides that a statement is not defamatory unless its publication has caused or is likely to cause serious harm to the claimant's reputation. In Lachaux the UK Supreme Court held that this requires proof of the actual impact of the words on reputation, not only their tendency. Section 5 gives website operators a defence for user posts if they follow the notice-and-takedown procedure in regulations made under the Act.

Why it matters here: A UK claimant must show real reputational harm, and the section 5 process is the formal route for asking a website operator to deal with a user's statement.
